A1 Swimming Policies, Procedures, Release of Liability, and Fee Agreement It is critical that you understand the Policies, Procedures, Release of Liability, and Fee Agreement of A1 Swimming School to ensure each student has a fun, rewarding and safe experience when learning to swim.
1.1 Class Times Each private, semi-private, or tri-private lesson is 30 minutes in length, one day per week. A class is held at the same time and day of the week, each week with the same coach for 4 or 8 consecutive weeks. Camps and Clinics’ lengths may be different.
1.2 Tuition and Fees Tuition is billed prior to the start of a package of lessons.
1.3 Registration Our lessons are on a perpetual consecutive basis. By purchasing a package of 4 or 8 lessons by which you agree to participate in the lessons on a consecutive basis once a week at the same time and day with the same coach.
1.4 Cancellations and Withdrawing from Lessons.
Any cancellation of a scheduled lesson is to be in written form via an email at least 24 hours prior to the appointment. We do not honor cancellation phone calls, verbal notices to our coaches, or any email cancellation after the 24-hour mark. Before the end of each lessons package you will receive an email from our administrative office whether you would like to re-register for more lessons or like to discontinue. Based on your reply to the email you can either complete your lessons and discontinue or re-register for more. If you request withdraw from lessons before the end of your package you will be charged $95 per class taken and $ 7 processing fee, then refunded the rest. If you reserve a slot and decide to withdraw before the start of your package you will automatically forfeit your lessons.
1.5 Refunds When you enroll your student in classes you are reserving a slot for your child that is in high demand. By reserving this spot, you are agreeing to pay for your reserved spot independent of your child's attendance. It is your responsibility to make sure that your vacations, appointments, and other activities do not interfere with the classes for which you have enrolled. A1 Swimming will offer no tuition refunds for 4 pack classes missed for any reason. Refunds will not be issued if the company is shut down or cannot fulfil its obligations because of unpredicted circumstances such as Act of God, Wars, Natural Disasters, National Emergencies, Pandemics, or any obstruction to our normal business operations. Refunds for early withdrawals are issued based on our Withdrawing from lessons policy. (~1.4)
1.6 Facility Closures In the case that a facility is closed due to inclement weather, maintenance or national holidays, a makeup class maybe be scheduled, or your account will be credited for the classes cancelled or extension of your current package will be offered. All credits will be applied to future tuition for lessons at A1 Swimming and cannot be converted to cash or transferred to any other party. Credits and make-ups may only be used at the A1 Swimming Swim School location at which they were given. If an appropriate make-up class can’t be scheduled, credit may be offered.
1.7 Make-Up Lessons and Student Absence Customers are eligible for one make-up lesson every 8 packages of lessons due to an absence. There is no make-up lesson for 4 lessons package. The make-up must be completed within four or seven weeks of the date of the absence based on the package purchased and is subject to availability as determined by A1 Swimming Swim School. No credits will be given if the student is unable to attend their already agreed on and scheduled make-up class. All make-up lesson arrangements are to be done through an email and are not transferable to any other party. The time offered for a make-up lesson can vary weekly, and we do not guarantee the same time and day as the regularly scheduled time. We do not guarantee that the same coach will teach the make-up lesson, but we will make a reasonable effort to schedule the client with their current coach. We reserve the right to offer a make-up lesson time 24 hours before the appointment. We will make two attempts to offer make-up times to a client. If none of those work the make up class will be deducted from subsequent tuition fee or refunded at the end of the package with $7 processing fee.
1.8 Continuing with more Lessons. If the client wants to continue with lessons for the next session, A1 Swimming can reserve a slot based on the availability two weeks prior, only after re-registration is done on the website or via an electronic invoice sent to the client who wishes to continue and re-registers for more lessons. Payment for the following session must be made two weeks before its start, which gives time for the provider to work on scheduling new clients based on vacant slots.
1.8 Methods of Payment Electronic card payments are the only payment methods accepted by A1 Swimming Swim School.
1.9 Coach and Class Changes Once you book your lessons you must remain with the same coach and time until the end of the package. If you are unsure if the coach will be appropriate for your lessons please book single lessons to try out or 4 lessons package with option to withdraw early and get charged the appropriate fees from section (~ 1.4 )
1.10 Trial classes .
We do not have any trial classes.
1.11 Timeliness Your lesson starts at exactly the time you have reserved and ends 30 min after. We cannot do any extensions or add extra time because our program is based on back-to-back lessons for every coach. If you are late for your lesson, it is considered lesson’s time taken. Plan accordingly to be able to attend and arrive for your lesson on time.
1.12 Parent/Guardian Attendance Participants’ parents/guardian must remain at the facility or on the pool deck during the entire duration of each lesson.
1.13 Rewards Students are rewarded with swim trophies and upon demonstration of skills required at each level beginner, intermediate and advanced. Every student will learn skills at different rates. Therefore, students will be tested for their trophies when their coaches believe they are ready.
1.14 Changing Areas, Restrooms and Locker Rooms - Dedicated Facilities Children under the age of 4 must be accompanied by a parent/guardian in a same sex changing room, restroom, or locker room. Children 4 years and older can use the same sex changing room, restroom, or locker room unaccompanied or the family changing rooms. Changing Areas, Restrooms and Locker Rooms - Hosted Facilities (Fitness Centers, Hotels, Apartment Complexes, Recreation Centers, etc.) Please refer to the hosted PBES facility locker room policies.
1.15 Swimsuits
Anyone entering the pool is required to wear appropriate swim apparel. Street clothing is not permitted. While it is not required, we highly recommend that little girls wear one-piece swimsuits.
1.16 Swim Diapers All students who are not fully potty-trained and all students under the age of three are required to wear a reusable (non- disposable) swim diaper. Disposable swim diapers (such as Lil’ Swimmers) can and should be worn under the non-disposable swim diaper. Reusable diapers have a tighter fit, which helps to avoid accidents in our pool. A swimsuit or a pair of shorts should be worn over the diaper. Even a small accident in the pool can close the pool down for as long as 24 hours. If you attend a hosted location and your student is under the age of three or not potty-trained, they will be required to wear one (1) disposable swim diaper and two (2) reusable diapers. If in doubt, PLEASE do not take the chance. 1.17 Watching Lessons in Our Facility Participants’ parents/guardian must remain at the facility during the entire direction of each lesson. Spectators may watch from the defined viewing area during their Participant’s class. Our goal is to give your child the best learning experience possible, so we ask you to refrain from interrupting your child’s class. If you have questions or requests for your instructor, you may ask several minutes before the end of the lesson. 1.20 Food and Snacks Food and drink are not allowed on the pool deck at any time. The only exception to this is bottled water in a non-glass container.
WAIVER AND RELEASE OF LIABILITY PLEASE READ CAREFULLY BEFORE ACCEPTING. THIS IS A RELEASE OF LIABILITY & WAIVER OF CERTAIN LEGAL RIGHTS.
The use of any facilities, services, equipment or premises used by a A1 Swimming Swim School program (collectively, the "Facilities"), and your participation in or visit to a A1 Swimming Swim School program, involve the risk of injury to you and your child, whether you or someone else causes it. Specific risks vary from one activity to another, and the risks range from minor injuries to major injuries, including catastrophic injuries such as drowning and death. You understand and voluntarily accept these risks and agree that A1 Swimming LLC, the owners and operators of the Facilities, the entities listed below, and such parties' respective officers, directors, employees, volunteers, property owners, managers, agents and independent contractors will not be liable for any injury (including, without limitation, personal bodily or mental injury), economic loss or any other damage (collectively, "Losses") to you, your spouse, child, guests, unborn child(ren), or relatives, whether caused by the active or passive negligence of the personnel. In addition to the terms above, you represent that you and your child are in good physical condition and that there is no medical condition or impairment that might prevent you or your child from participating in swimming instruction or using the Facilities. You further acknowledge that the Releasees have not given you or your child medical advice related to your physical condition and ability to participate. If you have any health or medical concerns now or later, discuss them with your doctor. The participant also agrees to indemnify A1 Swimming LLC for any damages incurred arising from any claims, demand, action, or cause of action by the participant, Acts of God, wars, pandemics, and various circumstances if that can hinder or cancel the ability of the company to finish or complete packages of lessons or stroke school seasons. The client agrees to indemnify A1 Swimming coaches liable for transmitting any deceases and viruses. The participant authorizes any representative of A1 Swimming LLC to have the participant treated in any medical emergency during their participation in the swim team, lesson program, or stroke school. Further, the participant and parent/guardian agree to pay all costs associated with medical care and transportation for the participant. The client/parent/guardian have noted on the registration form any medical/health problems of which the staff should be aware.
CONSENT FOR EMERGENCY MEDICAL TREATMENT In the event of a medical emergency, the undersigned Participant or Parent/Guardian of the Participant(s) listed below, hereby grants authorization to the A1 Swimming LLC, its management, directors and agents, franchisees, its members, associates and employees and owner/operators, to employ any legally licensed physician or health care facility on behalf of the participant, and to direct and/or order emergency medical treatment for the participants. Each of the undersigned also agrees that neither the A1 Swimming LLC, franchisees, owner/operators nor any of their respective representatives, shall be liable under any circumstances to anyone for exercising the foregoing authority in the event of an emergency.
PROMOTIONAL MATERIAL I grant A1 Swimming LLC, its representatives, and employees the right to take videos of me, parties to which I am legal guardian, and my property in connection with the above identified subject. I authorize A1 Swimming Holdings LLC, its assigns, and transferees to copyright, use and publish the same in print and/or electronically in perpetuity regardless of media/channel. I agree that A1 Swimming LLC may use such video of me with or without my name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, social media and web content. Participant or Parent/Guardian of the Participant(s) understands that photos and video are occasionally taken at theA1 Swim School for promotional and marketing purposes. Participant or Parent/Guardian of the Participant(s) agrees that likeness or comments or comments of any member of my family or guests may be used by A1 Swim School our promotional and marketing materials in any form.
I HAVE CAREFULLY READ ALL OF THE ABOVE INFORMATION. I ACCEPT AND ACKNOWLEDGE IT WITH FULL KNOWLEDGE OF ITS CONTENTS AND SIGNIFICANCE. I UNDERSTAND THAT THE INFORMATION HEREIN WILL GOVERN MY RELATIONSHIP AND THE RELATIONSHIP OF ANY PARTICIPANTS WITH A1 SWIMMING LLC. MY ACCEPTANCE HERE SUPERSEDES ANY OTHER AGREEMENT, WRITTEN OR ORAL, THAT MAY HAVE BEEN PRESENTED TO ME WITH RESPECT TO MY RELATIONSHIP WITH A1 SWIMMING SCHOOL.
